General terms and conditions of the Heuser-Metallprocessing online shop
§ 1 Scope for entrepreneurs and definitions of terms
(1) The following
general terms and conditions apply to all deliveries between us and a
consumer in the version valid at the time of the order. A consumer is
any natural person who concludes a legal transaction for purposes
that cannot primarily be attributed to their commercial or
independent professional activity (§ 13 BGB).
§ 2 Conclusion of a contract, storage of the contract text

(4) When an order is
received in our online shop, the following regulations apply: The
customer submits a binding contract offer by successfully completing
the ordering procedure provided in our online shop.
The order takes place in the following steps:
1) Selection of the desired goods
2) Confirm by clicking the “Order” button
3) Checking the information in the shopping cart
4) Press the “checkout” button
5) Login to the online shop after registering and entering your login details (email address and password).
6) Re-checking or correcting the respective data entered.
7) Binding dispatch of the order by clicking the “order for a fee” or “buy” button
Before the order is bindingly sent, the customer can go back to the website on which the customer's information is recorded and correct any input errors by pressing the "Back" button in the Internet browser he is using and after checking his details Closing the internet browser will cancel the ordering process. § 3 Subject matter of the contract, quality, delivery, availability of goods
(1) The subject matter of the contract is the goods and services
specified by the customer as part of the order and mentioned in the
order and/or order confirmation at the final prices stated in the web
shop. Errors and errors are reserved there, especially with regard to
the availability of goods.
(2) The nature of the goods ordered can be found in the product descriptions in the online shop. Illustrations on the website may only reflect the products inaccurately; Colors in particular can vary significantly for technical reasons. Images are for illustrative purposes only and may differ from the product. Technical data, weight, dimensions and performance descriptions are given as precisely as possible, but may contain the usual deviations. (3) If no copies of the product selected by the customer are available at the time of the customer's order, the provider will inform the customer of this in the order confirmation. If the product is permanently unavailable, the provider will not issue a declaration of acceptance. A contract is not concluded in this case.
(4) If the product specified by the customer in the order is only temporarily unavailable, the customer will also be informed of this immediately in the order confirmation. If delivery is delayed by more than two weeks, the customer has the right to withdraw from the contract. In this case, the provider is also entitled to withdraw from the contract. He will immediately reimburse any payments the customer may have already made.
§4 Prices, shipping costs, payment, due date

§5 Retention of title

inform you of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the attached >sample cancellation form<, although this is not mandatory.
Consequences of Withdrawal
If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment.
We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.
You bear the direct costs of returning the goods.

(1) The contract language is German.
(2) To the extent legally permissible, the law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
(3) Changes or additions to these general terms and conditions must be made in writing, otherwise they are void. This also applies to changes to this clause.
(4) To the extent legally permissible, the place of jurisdiction for all disputes arising from the contractual relationship is the registered office of the seller.
